Terms of Service

Plain-language summary:You buy a spot on the Weirdest Billboard wall. Pay once — your placement is guaranteed to stay live for at least two years from your purchase date, and will continue for as long as the Platform operates. We can remove content that violates these terms, but we’ll always tell you why. Nothing in these terms limits rights you have under Australian Consumer Law.

1.About these terms

These Terms of Service (“Terms”) govern your access to and use of the Weirdest Billboard platform at weirdestbillboard.com (the “Platform”), operated by Weirdest Billboard (“we”, “us”, “our”) from Australia.

By purchasing a pixel placement or using the Platform, you agree to these Terms. If you are purchasing on behalf of a business, you confirm you have authority to bind that business to these Terms.

These Terms are governed by the laws of the Australian Capital Territory. Nothing in these Terms excludes, restricts, or modifies any rights or remedies you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).

2.The service

Weirdest Billboard provides a shared digital billboard — a 200×120 pixel grid publicly displayed at weirdestbillboard.com. Buyers may purchase blocks of pixels (“Placements”) to display their brand, artwork, or message on the wall.

Key characteristics of the service:

  • Guaranteed placement: Your Placement is guaranteed to remain live and visible on the wall for a minimum of two years from your purchase date (the “Guarantee Period”), provided the Platform remains operational. After the Guarantee Period, your Placement continues for the lifetime of the Platform at no additional cost.
  • One-time payment: A single upfront payment secures your Placement. There are no recurring fees or renewal requirements.
  • Moderated: All Placements are reviewed before going live to ensure they meet our Content Standards (see section 5).
  • Clickable: Each Placement links to a destination URL you provide at checkout.

3.Purchasing a placement

Eligibility. You must be at least 18 years of age to make a purchase. By completing checkout you confirm you meet this requirement.

Minimum size. The minimum Placement size is 5×5 pixels (25 blocks). Larger selections provide proportionally greater visibility.

Pricing. Prices are displayed in Australian dollars (AUD) and are inclusive of GST where applicable. The price for your selection is confirmed at checkout before payment is taken. Pricing is calculated at a flat rate per block, with an optional centre-boost surcharge for placements in the high-demand centre region of the grid. We reserve the right to update pricing for new purchases at any time; your confirmed purchase price will not change after checkout.

Payment. Payments are processed by Stripe. By completing payment you also agree to Stripe’s terms of service. We do not store your card details.

Reservation. Your selected blocks are held for 30 minutes while you complete checkout. If payment is not received within this window, the reservation expires and the blocks become available to other buyers.

Order confirmation. A confirmation email is sent to the address you provide after successful payment. Retain this email as your proof of purchase.

4.Refunds and cancellations

General policy. Due to the permanent and space-limited nature of pixel placements, purchases are non-refundable once a Placement has gone live on the wall.

Rejected submissions. If your submitted content is rejected during moderation and we are unable to resolve the issue with you, a full refund will be issued promptly. You will receive an email explaining the reason for rejection.

Australian Consumer Law. Nothing in this section limits your rights under the Australian Consumer Law. If a service fails to meet a consumer guarantee, you may be entitled to a remedy. Please contact us at hello@weirdestbillboard.com to discuss your situation.

Change of mind. We do not offer refunds for change of mind after a Placement has gone live, as the blocks you purchased are no longer available to other buyers.

5.Content standards

All content submitted for display on the Weirdest Billboard wall must comply with the following standards. Content that does not comply will be rejected or removed.

Permitted content:

  • Business logos, branding, and advertisements for lawful goods and services
  • Community group announcements and not-for-profit promotions
  • Personal messages, artwork, and creative expression
  • Memes, pop culture references, and humorous content (family-friendly)
  • Links to lawful websites with appropriate content

Prohibited content. The following is not permitted under any circumstances:

  • Content that is sexually explicit, pornographic, or adult-only in nature
  • Content that is hateful, discriminatory, or vilifying of any person or group based on race, religion, gender, sexuality, disability, or other protected attributes
  • Content that harasses, threatens, or targets a specific individual
  • Depictions of graphic violence or gore
  • Content that advertises illegal goods or services, including illegal drugs, unlicensed firearms, or fraudulent schemes
  • Spam, misleading advertising, or content designed to deceive users
  • Content that infringes the intellectual property rights of a third party
  • Malicious links, phishing URLs, or destination URLs that redirect to harmful content
  • Content that violates any applicable Australian law

Relevance. We are a multi-city platform. Content should be broadly relevant to the city it appears in. We reserve the right to decline content that has no connection to our community at our discretion.

6.Moderation

Every Placement is reviewed by our team before going live. We aim to complete reviews within 24 hours of purchase.

Approval: Once approved, your Placement goes live and is visible to all visitors. You will receive an email notification.

Rejection: If your content is rejected, you will receive an email explaining the reason. A full refund is issued immediately. You may resubmit with compliant content.

Removal after going live: We may hide or remove a Placement that has already gone live if we become aware it violates these Terms or if a valid complaint is received. We will notify you by email and provide a reasonable opportunity to respond before permanent removal, unless the content poses an immediate harm.

No liability for delays: We are not liable for any loss arising from delays in the moderation process.

7.Intellectual property

Your content. You retain ownership of the images, logos, and artwork you upload. By submitting content for display, you grant Weirdest Billboard a non-exclusive, royalty-free licence to display your content on the Platform and in promotional materials relating to the Platform (for example, screenshots of the wall used in marketing).

Your warranties. By submitting content, you warrant that:

  • you own the content or have all necessary rights and permissions to use it;
  • displaying the content on the Platform does not infringe any third party’s intellectual property rights; and
  • the content complies with the Content Standards in section 5.

Our platform. The Weirdest Billboard name, branding, website design, and underlying software are owned by us and protected by copyright and trade mark law. You may not reproduce or use them without our written permission.

8.Availability and changes to the platform

Placement guarantee. We guarantee that your Placement will be live and publicly visible on the Platform for a minimum of two years from your date of purchase (“Guarantee Period”), subject to your content continuing to comply with the Content Standards in section 5. After the Guarantee Period, your Placement will continue to be displayed for as long as the Platform operates, but this ongoing display is provided as a benefit and not as a contractual commitment.

Platform shutdown. We intend to keep the Platform running indefinitely. In the unlikely event that we permanently shut down the Platform, we will provide at least 90 days’ written notice to all active buyers by email. If the Platform ceases to operate before the end of your Guarantee Period, we will issue a pro-rata refund of your purchase price calculated on the portion of the Guarantee Period remaining at the date of shutdown.

Maintenance and downtime. The Platform may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We will endeavour to minimise disruption and communicate planned maintenance in advance. Temporary unavailability does not extend the Guarantee Period.

Changes to the Platform. We may modify the features, design, or functionality of the Platform at any time. We will not make changes that materially reduce the visibility of existing live Placements without reasonable notice.

9.Limitation of liability

To the maximum extent permitted by Australian law:

  • Our total liability to you for any claim arising out of or in connection with the Platform is limited to the amount you paid for your Placement.
  • We are not liable for any indirect, consequential, incidental, or special loss or damage, including loss of profit or business opportunity.
  • We are not responsible for the content, availability, or practices of third-party websites linked from Placements on the wall.

These limitations do not apply to liability that cannot be excluded under the Australian Consumer Law, including liability for personal injury caused by our negligence.

10.Privacy

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Platform you consent to the practices described in the Privacy Policy.

11.Changes to these terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. For material changes that affect existing buyers, we will provide email notice at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

12.Contact and disputes

If you have a question, concern, or complaint about these Terms or your Placement, please contact us first — most issues can be resolved quickly and informally.

If we cannot resolve a dispute informally, either party may seek resolution through the ACT Civil and Administrative Tribunal (ACAT) or the courts of the Australian Capital Territory.
